These Terms of Service ("Terms") govern your access to and use of Cube Chat, including the Cube Chat website, mobile application, chat services, and related features (collectively, the "Service").
By creating an account or using Cube Chat, you agree to these Terms. If you do not agree with these Terms, do not create an account or use the Service.
These Terms apply together with the Cube Chat Privacy Policy.
Cube Chat is intended for users who are 13 years of age or older.
You may not create or use a Cube Chat account if you are under 13.
If you are a minor under the age of majority where you live, you should use Cube Chat only with the involvement and permission of your parent or legal guardian where required by applicable law.
By creating an account, you represent that you meet the applicable age requirement.
Some Cube Chat features require an account.
When creating an account, you agree to provide accurate information and to keep your account information reasonably secure.
You are responsible for maintaining the confidentiality of your Cube Chat account password and for activity conducted through your account, except where the activity results from circumstances for which you are not legally responsible.
You should not share your Cube Chat account password with other people.
You may not impersonate another person or create an account using information intended to deceive other users.
Cube Chat may suspend or terminate an account that violates these Terms, applicable law, or materially threatens the security or operation of the Service.
Cube Chat allows users to connect to chat servers using a server address, port, and server password.
A server password is separate from your Cube Chat account password.
You are responsible for entering the correct server information and for keeping server passwords confidential.
When you connect to a server, Cube Chat may transmit the server password to the server you are attempting to connect to so that the server can authenticate your connection.
You should not use your Cube Chat account password as a server password unless you intentionally choose to do so.
Cube Chat does not control every server that a user may attempt to connect to. A server operator may have separate rules, privacy practices, or requirements.
You are responsible for making sure that you are authorized to connect to any server you use through Cube Chat.
Cube Chat allows users to send chat messages through connected chat servers.
You are responsible for the content of messages and other material that you send through Cube Chat.
You agree not to use Cube Chat to:
Cube Chat does not guarantee that messages will always be delivered, received, stored, or displayed.
Messages may be processed or transmitted by the Cube Chat service and/or the server to which you connect.
You retain whatever rights you may have in content that you create and send through Cube Chat, subject to the rights of other people and applicable law.
By using Cube Chat to transmit content, you grant Cube Chat the limited rights reasonably necessary to operate the Service, including transmitting and processing that content as necessary to provide the chat functionality you request.
This does not give Cube Chat ownership of your personal messages.
You are responsible for ensuring that you have the necessary rights to send any content that you transmit through Cube Chat.
You may not use Cube Chat to:
Nothing in these Terms prevents conduct that is protected by applicable law.
Cube Chat and its software, website design, logos, graphics, and other materials provided by Cube Chat are owned by or licensed to Cube Chat and are protected by applicable intellectual-property laws.
Except as expressly permitted by these Terms or applicable law, you may not:
Cube Chat grants you a limited, non-exclusive, non-transferable, revocable license to use the Cube Chat software and Service for their intended purposes while you comply with these Terms.
This license does not transfer ownership of Cube Chat or its software to you.
Cube Chat uses third-party services to operate certain features.
For example, Cube Chat uses OneSignal to provide push notifications on the website and Android application.
Third-party services may have their own terms, privacy policies, technologies, and practices.
Cube Chat is not responsible for independent services operated by third parties, except to the extent required by applicable law.
Your use of a third-party service may also be subject to that provider's terms.
Cube Chat may use OneSignal to provide push notifications.
You may be able to enable or disable push notifications through your browser or device settings.
Disabling push notifications may prevent Cube Chat from sending notifications to your device or browser.
Information processed by OneSignal is described further in the Cube Chat Privacy Policy.
Cube Chat provides an account deletion function.
You may initiate deletion of your Cube Chat account through the account functionality provided by Cube Chat.
When an account is deleted, Cube Chat will delete information stored in its own systems as described in the Privacy Policy, subject to information that Cube Chat is legally required or permitted to retain.
Information independently held by third-party services may be subject to those services' own retention and deletion practices.
Deleting a Cube Chat account does not necessarily delete information that a server operator or other third party independently holds.
You may stop using Cube Chat at any time.
Cube Chat may suspend or terminate access to an account or the Service when reasonably necessary, including where:
Where appropriate and reasonably possible, Cube Chat may provide notice before taking action. However, immediate action may be taken when necessary to protect the Service, users, or others.
Termination does not eliminate rights or obligations that by their nature should continue after termination.
Cube Chat is provided on an ongoing basis, but uninterrupted availability is not guaranteed.
The Service may become temporarily unavailable because of:
Cube Chat may modify, suspend, or discontinue features of the Service.
Cube Chat takes reasonable measures to protect the Service and information handled through it.
However, no internet-based service can guarantee absolute security.
You are responsible for using reasonable security practices, including keeping your passwords confidential and using secure devices.
If you believe your Cube Chat account has been compromised, contact Cube Chat as soon as reasonably possible.
Cube Chat's collection, use, and handling of personal information is described in the Cube Chat Privacy Policy.
The Privacy Policy is incorporated into these Terms by reference.
To the extent permitted by applicable law, Cube Chat is provided on an "as is" and "as available" basis.
Cube Chat does not guarantee that:
Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot legally be excluded or limited under applicable law.
To the maximum extent permitted by applicable law, Cube Chat and its operators will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.
This may include losses resulting from service interruptions, message delivery failures, loss of data, or conduct of third-party server operators.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
Cube Chat allows users to enter server addresses and connect to servers.
Cube Chat does not necessarily operate or control every server that may be accessible through the Service.
Server operators may independently control their servers, authentication systems, content, availability, and rules.
You are responsible for complying with the rules of any server you connect to.
Cube Chat is not responsible for the independent conduct, content, policies, or availability of third-party servers, except where applicable law provides otherwise.
Cube Chat may modify or update the Service, including adding, removing, or changing features.
We may also update these Terms from time to time.
When we make material changes, we may provide notice through the Service or another reasonable method where appropriate.
The updated Terms will include a new "Last Updated" date.
We may revise these Terms when necessary to reflect changes to Cube Chat, legal requirements, security practices, or other legitimate reasons.
If a change materially affects your rights or obligations, we will make reasonable efforts to provide appropriate notice.
If you do not agree with updated Terms, you should stop using Cube Chat and may delete your account.
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Nothing in this section prevents you from exercising mandatory rights or remedies available to you under the laws that apply to you.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue to apply to the extent permitted by law.
These Terms and the Cube Chat Privacy Policy constitute the agreement between you and Cube Chat concerning your use of the Service, except where additional terms are expressly provided for a particular Cube Chat feature.
If a provision of these Terms conflicts with a mandatory legal requirement, the mandatory legal requirement will apply.
